US Privacy Rights
This page contains additional information relevant to residents of certain states that have their own data privacy laws, regulations and associated rights. This content is part of, and should be read in conjunction with, our Privacy Policy.
IIf you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Montana, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have certain rights regarding the use of your Personal Information. This section describes those rights and how you may exercise them. We reserve the right to deny any requests made pursuant to the rights listed below if the law does not allow or require us to comply with them.
Notice to VICI Employees: information regarding the Personal Information we process from our employees will be distributed directly to our employees. If you have any questions about our practices regarding employee Personal Information, please contact human resources.
(1) The right to notice that Personal Information will be collected:
You have the right to know certain information about our collection and use of consumers’ Personal Information over the past 12 months. The categories of such Personal Information are listed below along with the general sources of that information, the purposes for which we collect it, the types of third parties to whom we have disclosed it, and the purposes for such disclosure.
For all of the categories listed in this section, unless otherwise noted: (i) we do not sell your Personal Information or use it for targeted advertising; (ii) we do not create profiles on individuals that produce legal or similarly significant effects; and (iii) we keep your Personal Information for the time period necessary to achieve the legitimate business purposes outlined in our Privacy Policy, taking into account the business needs and efficiencies related to administering our business (such as resolving disputes, conducting audits and enforcing agreements) and the records retention requirements under applicable law.
- Identifiers and Personal Information categories listed in Cal. Civ. Code § 1798.80(e) (such as a name, postal or email address, IP address, or account name).
- We may collect this information for a variety of business purposes, including providing our Services, communicating with you and administering our business. We collect this information directly from you. In the past 12 months, we may have shared this information with our vendors and service providers. Namely, we may have shared this information with our IT vendors to obtain IT support and manage our systems, and with our communications service providers to respond to your requests, communicate with you regarding our Services, or otherwise administer our business.
- Internet or other similar network activity (such as browsing history or a consumer’s interaction with a website, application or advertisement) and Geolocation.
- We may collect this information for a variety of business purposes, including managing and improving our Website, for IT support and maintenance, and to prevent fraud or secure our Website. Information collected by cookies and other internet trackers can sometimes be used to infer a general geolocation, such as city and state. We collect this information directly from you. In the past 12 months, we may have shared this information with our vendors and service providers to obtain IT support or website analytics, manage our systems, prevent fraud, or otherwise administer our business.
We do not collect any Personal Information from the following categories: commercial information; biometric information; sensory data; nonpublic education information; nonpublic employment-related information such as job history or performance evaluations; inferences drawn from other Personal Information; or protected classification characteristics under California or federal law. We also do not collect the Personal Information of children or any sensitive Personal Information as defined by comprehensive state privacy laws.
(2) Your additional state privacy rights:
Depending on your state of residence, you may have the right to:
- Request to know more about the Personal Information that we collect, use, and disclose. Once we receive your request, we may disclose:
- The categories of Personal Information we’ve collected about you
- The categories of sources for Personal Information we’ve collected about you
- Our business or commercial purpose for collecting and/or sharing or selling that Personal Information
- The categories of Personal Information that we’ve shared with or sold to third parties
- The categories of third parties with whom we’ve shared, or to whom we’ve sold, that Personal Information (residents of Delaware, Maryland, Minnesota, and Oregon have the right to request a list of such third parties)
- The specific pieces of Personal Information we’ve collected about you
- Request to access your Personal Information, including in a portable format
- Request deletion of your Personal Information
- Request correction of inaccurate Personal Information
- Opt-out of the sale or sharing of Personal Information for targeted or cross-context behavioral advertising, or limit the use of Sensitive Personal Information
- Not be discriminated against for exercising these rights
Pursuant to state privacy laws, we may deny your request, in whole or in part, under certain legal exceptions or prohibitions. In the event that we deny your request, to the extent permittable we will inform you of the basis for its denial.
(3) Exercising your state privacy rights:
If you are a resident of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Montana, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, and would like to make a request pursuant to any of the rights described in this section, you may do so by following the instructions on the FORM FOUND HERE. (4) Process for verifying a request to know or delete information:
In order to protect your Personal Information, we are required to verify that any person making a request under this section is in fact you or your authorized agent. We will verify any consumer’s request to exercise the right to know or the right to request deletion by comparing the identifying information you provide with the Personal Information we already have in our systems.
If you are requesting to know the categories of Personal Information collected, we may require you to provide two data points that match two of the data points we maintain. These data points may include: full name, organization name, email or mailing address, phone number, and your contact person at VICI. We will use this information only for the purposes of verifying that your request is authentic. However, if you request to know specific pieces of information, a higher bar for verification is required, which may require us to match three data points of information provided by you with three data points that we maintain.
When you make a request to delete your Personal Information, the level of reasonable certainty required during our verification process will vary depending on the nature of the Personal Information you wish to have deleted. We will act in good faith when determining what standard to apply when verifying all consumer requests.
You may designate an authorized agent to act on your behalf to make a privacy request. If you use an authorized agent for requests to know or delete, we may require that you provide your authorized agent with written permission to exercise your privacy rights.
Once we receive your request, where required by law, we will respond within 10 business days and inform you if we need any more information in order to verify your request. We will provide the information you requested within 45 days of your request. If we require more than 45 days to respond to your request, we will inform you of the reasons why.
We do not charge a fee to process or respond to your consumer request unless it is excessive, repetitive or manifestly unfounded. If we deny your request, in whole or in part, we will inform you of the basis for its denial.
Your right to appeal our response to your privacy rights requests:Residents of Colorado, Connecticut, Minnesota, Montana, Oregon, Texas, and Virginia have the right to appeal our decisions in response to the exercise of your privacy rights requests. To initiate an internal appeal, please contact us by filling out the FORM FOUND HERE, by calling (833) 380-0318 or by sending an email to INVESTORS@VICIPROPERTIES.COM. We will respond to your request for an internal appeal within 45 days. If you are unhappy with the results of your appeal, you may contact your state attorney general.
